Terms of Service
Effective Date: January 1, 2026
These Terms of Service govern the use of services provided by Elephant Studio, legally incorporated as 9538-3659 Québec Inc., operating in the Province of Québec, Canada.
By engaging our services or using our website, you agree to these terms.
1. Services
Elephant Studio provides professional video editing, creative production, and related digital services on a project basis or subscription basis.
Scope of work, deliverables, and timelines are defined in written agreements, proposals, or onboarding documents.
2. Payment Terms
All fees are stated in writing prior to project initiation.
- Project based services may require an upfront deposit.
- Subscription services are billed monthly in advance unless otherwise agreed.
- Invoices are payable upon receipt unless stated otherwise.
- Late payments may incur interest charges or service suspension.
Failure to pay may result in withholding of deliverables and termination of services.
3. Refund Policy
Deposits are non refundable.
Work completed, partially completed, or in progress is billable. Subscription fees already processed are non refundable unless otherwise agreed in writing.
4. Revisions
Revision rounds are limited as defined in the project agreement or subscription scope.
Additional revisions beyond agreed scope may incur additional fees.
5. Intellectual Property
Upon full payment, the Client receives rights to the final approved deliverables.
Elephant Studio retains ownership of:
- Editing templates
- Internal workflows
- Pre existing assets
- Proprietary techniques
Raw project files, unless explicitly transferred in writing, remain the property of Elephant Studio.
Elephant Studio reserves the right to display completed work in its portfolio unless otherwise agreed in writing.
6. Client Responsibilities
The Client is responsible for:
- Providing accurate content and materials
- Ensuring all submitted materials are legally owned or licensed
- Securing rights to music, footage, or third party assets unless otherwise agreed
- Reviewing deliverables in a timely manner
7. Acceptable Use
Elephant Studio reserves the right to refuse or terminate services for projects involving illegal activity, hate content, fraud, deceptive practices, or other harmful conduct.
8. Confidentiality
All client materials are treated as confidential. Contractors working under Elephant Studio are bound by confidentiality obligations.
9. AI Assisted Workflows
Elephant Studio may utilize artificial intelligence tools to enhance workflow efficiency, editing optimization, and communication processes.
Client content remains confidential and is processed in accordance with our Privacy Policy.
10. Limitation of Liability
Elephant Studio shall not be liable for indirect, incidental, consequential, or special damages arising from use of our services.
Total liability shall not exceed the amount paid by the Client for the specific service giving rise to the claim.
11. No Performance Guarantees
Elephant Studio does not guarantee specific marketing, advertising, sales, or performance outcomes from delivered content.
12. Termination
Either party may terminate services in writing.
Outstanding balances remain due upon termination.
13. Independent Contractors
Elephant Studio operates using independent creative professionals. Nothing in this agreement establishes employment, partnership, or joint venture relationships with clients.
14. Governing Law
These Terms are governed by the laws of the Province of Québec and applicable federal laws of Canada.
15. Amendments
Elephant Studio reserves the right to update these Terms at any time. Continued use of services constitutes acceptance of revised terms.
